Between November 6, 2024 and December 29, 2025, New Era Energy told investors it was making meaningful progress on its Texas Critical Data Centers project and responsibly managing its legacy gas-well business. Executives emphasized engineering advances, permitting and regulatory work, land expansion, and financial reports describing how the company accounted for well-plugging and site-restoration obligations.

However, during this period, investors allege New Era Energy had not actually submitted the needed permits for the Texas project and was tied to a plan that moved valuable New Mexico wells through related entities while leaving cleanup costs behind. New Era Energy allegedly failed to disclose required permit applications for the flagship data-center project had not been filed despite the company’s claims of progress, the company was allegedly benefiting from related-party well transfers and bankruptcies that avoided plugging and remediation costs, and those issues made its financial results and public statements unreliable.
