Between June 26, 2025 and June 24, 2026, Alibaba filed annual reports disclosing that its online and mobile commerce businesses required an operating license from China's Ministry of Industry and Information Technology (MIIT), and separately described the risk of AI-related data misuse and "unauthorized distillation of third-party models" as merely hypothetical or inadvertent.
However, investors allege Alibaba omitted that its affiliation with the MIIT qualified it as a "Chinese military company" under the FY2025 National Defense Authorization Act, a designation that had led to other Chinese companies being delisted from U.S. exchanges, and that its distillation of third-party AI models was not a hypothetical risk but an ongoing practice.
Then, on June 8, 2026, the U.S. Department of Defense released an updated list of Chinese military companies that included Alibaba due to its affiliation with the MIIT.
On this news, Alibaba shares fell 3.9%, closing at $115.38 on June 10, 2026.
Additional revelations followed on June 24, 2026, when Bloomberg reported that Anthropic PBC had accused Alibaba of waging a large-scale campaign to illicitly access its Claude AI model, using roughly 25,000 fraudulent accounts to conduct 28.8 million exchanges between April and June 2026.
